Should the State impose limits on the freedom of discrimination in commercial establishments?

This was the theme of our Simulated Jury: on the one hand the group says that the State should impose limits and on the other that there should be no limits
On July 12th, the third Simulated Jury of Líderes took place in 2021. This format consists of holding a debate on a current issue, through the constitution of defense and prosecution groups.
"Should the State impose limits on the freedom of discrimination in commercial establishments?" was the theme chosen to promote the reflection about limits of freedom, as well as in relation to the hypotheses of discrimination between people who seek a certain commercial establishment for the consumption of goods or services.
The favorable group was formed by Sergio Coser, Pedro Henrique Zordan and Murilo Carvalho; the group against was formed by Victor Casagrande, Pedro Mutzig and Caroline Caliman. Associate III and event leader, Eduardo Passamani, led the Jury. He also brought in his briefing: “(...) every business activity takes into account the freedom of choice, which involves what should be produced, how much, when, how and where it should be produced, as well as for whom it should be produced . The entrepreneur needs to identify the group of people who will buy their goods or enjoy their services. Does it happen that, when placing your product or service on the market, will the entrepreneur be able to choose who to sell to? Or, in other words, would he have the right to choose who not to sell to? What is the limit for freedom from discrimination? Or, in the Jury's plot, must there be a limit?"
At the end of the presentations, the judges voted and the group against won, by 7x2. In recent editions, everyone present could vote, however, we launched a new format in which the jury is formed prior to the event and the Jury wins whoever manages to convince the panel of the topic in question.
